One of the biggest mistakes home buyers make is driving around and calling agents on yard signs to ask about a home. THIS IS NOT IN A BUYERS BEST INTEREST!! WHY??? Laws require the agent on the yard sign (the listing agent) to work in the SELLER'S best interest, not yours (the buyer). The seller's agent may not reveal things to you about the homes condition or items in general that would negatively affect the price or the amount the seller would take for the home. THE BEST ADVISE... get your own BUYERS AGENT as soon as you plan to start looking for a home. Once you enlist the services of a buyer's agent, they are required by law to work with you in YOUR best interest. About For Sale By Owners (FSBO)'s)- Only about 13% of homes sold are done so by For Sale by Owner and statistics show that number is on the decline. Most buyers know that FSBO's take on the challenge of trying to sell their own home simply to try and save paying a small commission. After several months of open houses, paid ads and no offers, they may very well significantly lower their price in hopes of motivating a buyer. When they reach their limit of anxiety and desperation sets in, they may end up taking less than had they listed their home with and agent who marketed the home better, sold it quicker and paid commissions after all. For buyers, this means you may be able to purchase a FSBO home for less than it's real market value. In other cases,,,, uniformed FSBO's price their homes too high, and hope someone sees the sign in their their yard. FSBO Buyers,,, for your protection, use a licensed real estate agent to represent you in the purchase of a FSBO home. Real estate laws can be very complex and unguided decisions can be costly. Many For Sale By Owners do not realize that they are bound by the same Fair Housing and Disclosure laws as Brokers, Agents and Lenders are and home sales have been lost because of misrepresentation and misinterpretation of what was negotiated. We always use the official Kansas City Regional Association of Realtors approved contracts and documents, specifically written for homes sold and purchased in this area. For your protection, don't settle for anything less. When all is said and done, most For Sale By Owners will welcome an agent who brings them a buyer and will compensate the agent with a commission. Let your agent contact the seller first though before you ever set foot in a FSBO home. If the seller is not willing to compensate an agent, perhaps there are underlying factors with the home they do not want a trained and experienced real estate agent to discover. Another reason they may not want to pay commissions,,,,they don't have to move but are simply testing the waters to see if an unrepresented buyer comes along and is willing to pay what the seller thinks their home is worth. The best advise for you as a buyer,,,,,,have a trained real estate agent represent you in the purchase of a For Sale By Owner home. Unlike some agents who charge their FSBO buyers and even their NON-FSBO buyers rediculous fees like contract processing fees and/or administrative fees at closing, we charge our buyers NOTHING when helping you find and buy a home!!
